Clear Voice Networks, LLC has prepared this Acceptable Use Policy (“Policy”) as a guide for its customers to understand the intended and permissible uses of our service and to prevent exploitation, fraud, and abuse of its unlimited calling plans and features. This Policy applies to all our services.

1. Normal, Reasonable Business Use

Clear Voice Networks, LLC’s unlimited business service plans and features are for normal business use. Usage must be in accordance with this Policy, our General Terms and Conditions, and consistent with the types and levels of usage by typical customers on the same business calling plan. Unauthorized or excessive use beyond that normally experienced by typical business customers may create network congestion, resulting in increased busy signals for themselves and others, and may lead to service termination.

2. Impermissible Business Use

Clear Voice Networks, LLC evaluates customer usage by comparing it to typical levels of permissible usage engaged in by legitimate customers. The following activities are impermissible under our unlimited business plans and considered outside of normal business use:

Operating a call center

Resale of telecommunications services

Auto-dialing or fax/voice blasts

Telemarketing

Operating or connecting to multi-party conference calling

Operating or connecting to multi-party “chat” lines

Engaging in activities that generate minutes resulting in revenue-sharing by the customer

Traffic without live dialogue, including use as a monitor, intercom, or for transcription purposes

A customer’s aggregate usage may be considered abnormal if it exceeds 3,000 minutes per month combined with excessive:

Unique numbers called

Call lengths

Call forwarding/transferring

Conference calling

Short duration calls

Number of calls made per month

Number of calls to a conference calling service

Calls terminated and re-initiated consecutively, resulting in excessive call lengths

Other abnormal calling patterns indicative of an attempt to evade enforcement of this Policy

Even if the number of minutes used is not excessive, Clear Voice Networks, LLC may still determine that abnormal or impermissible usage is occurring based on:

Unique numbers called

Call lengths

Frequency of call forwarding/transferring

Conference calling

Short duration calls

Number of calls made per month

Number of calls made to a conference calling service

Calls terminated and re-initiated consecutively

Other calling patterns indicative of policy evasion

3. Lawful and Appropriate Use

Customers may not use our service or devices in any way that is illegal, fraudulent, improper, or inappropriate. This includes, but is not limited to:

Using automated means to manipulate our service

Violating any law, rule, or regulation

Infringing upon any third party’s intellectual property or personal rights

We reserve the right to review Customer’s account and take appropriate actions, including but not limited to:

Suspending service if usage is beyond normal standards

Notifying the Customer and providing an opportunity to correct improper usage

Transferring the Customer’s service to a more appropriate plan

Charging applicable rates for the adjusted plan

Implementing other limitations

Suspending or terminating service with or without notice

If we believe that our service has been used for unlawful purposes or in violation of this Policy, we may:

Immediately terminate the Customer’s service with or without notice

Forward relevant communication and other information to the appropriate authorities for investigation and prosecution

Exercise all legal rights available to us

4. Policy Changes

Clear Voice Networks, LLC reserves the right to modify this Policy at any time. Changes shall become effective when a revised Policy is posted to our website.
